If the judge rejects the motion, Palmer said he
would ask her to give Dalton "shock probation."
That would send him to prison for six months,
then return him to probation.
Dalton's father, Mark Sons, said his son's legal
problems are creating a "nightmare" for the
entertainer and his family.
Dalton was placed in solitary confinement this
week after jail guards accused him of failing to
follow directions, his father said. He will be con-
fined alone in a 32-square-foot cell, which is
called the "box," for 20 days, he said.
The performer's father said his son was roused
from sleep at 2 a.m. during a search of a commu-
nal cell designed to hold 40 people.
He asked for permission to use the toilet before
he left the cell, Sons said. When he flushed the
toilet, jail guards told him that was against the
rules while a search was underway, he said.
"He had been asleep, and he never heard them
say that," Sons said.
Sons said he has already advised Dalton to
move out of Denton County when he regains his
freedom. His parents said they are concerned that
he is being unfairly targeted by police officers
and other members of the local criminal justice
system.
Palmer said he doubts that Dalton's line of
work is creating problems for him in the legal
system. But his parents said Dalton's profession
is well known in Denton County.
Prosecutors dropped the assault charges
against Dalton after his probation was revoked.
Palmer said it is standard practice for prosecutors
to take a probationer to court on a revocation
hearing before new charges are tried because
only a "preponderance of guilt" rather than the
standard of reasonable doubt is applied in such a
hearing.
A jury would have been unlikely to convict
Dalton on the assault charge in light of the evi-
dence presented, Palmer said.
Palmer said that he is hopeful the judge will
reverse her decision because the punishment
handed down to Dalton is severe. The judge's
finding surprised many people, he said.
"I don't believe he committed an assault, peri-
od," Palmer said.
Francis maintains that she was assaulted, and
she claims that she is being made a scapegoat by
Adult video star Mark Dalton denies assaulting his former
girlfriend, Rebecca Jo Francis.
Dalton's family. The entertainer's mother and
father have criticized Francis and vowed to con-
tinue fighting a legal battle for their son's free-
dom.
"I'm being put down to make his image look
better, and I don't think that's fair," Francis said.
Francis noted that Dalton's criminal record
reveals 11 alleged violations ranging from minor
to serious over a four-year period. But Dalton has
been convicted of only six of the charges, and the
others were dismissed, according to Denton
County records. The convictions include posses-
sion of a controlled substance, leaving the scene
of an accident, driving while intoxicated and
driving with a suspended license.
Dalton's controlled substance conviction arose
from his possession of GHB. The bodybuilder
said he bought the muscle-building drug —
which has been used illegally to spike drinks and
is known as a "date rape drug" — at a health food
store for his health regimine when it was still
legal.
Dalton said in a recent interview that he had
expected to complete his probation without inci-
dent.
His probation officer, Erika Martin, testified
during the hearing that Dalton paid his monthly
fees late three times and began community serv-
ice behind schedule. Except for those infractions,
he was meeting the requirements of his proba-
