This proceeding involves the mutually exclusive applications
of East Tennessee Public Communications Corporation
(East Tennessee), Knoxville Community
Broadcasting, Inc. (Community). and Lincoln Memorial
University (Lincoln) for a construction permit for a new
noncommercial educational television station to be operated
on Channel 15 at Knoxville, Tennessee. The applications
were designated for hearing on the following
issues:
1. To determine the extent to which each applicant's
proposed operation will be integrated into the
overall cultural and educational objectives of the
respective applicants:
2. To determine the manner in which each applicant's
proposed operation meets the needs of the
community to be served;3. To determine whether the factors in the record
demonstrate that one applicant will provide a superior
noncommercial educational broadcast service:
4. To determine, in light of the evidence adduced
pursuant to the foregoing issues. which of the applications
should be granted.
2. A hearing was held on October 27. 1986: proposed
findings of fact and conclusions of law were due on
December 3. 1986 and on that date findings were filed by
East Tennessee and Community. Lincoln filed on December
4. 1986 and it has not sought leave to file late. Replies
were due December 30. 1986 and East Tennessee and
Community filed on that date. Lincoln filed a late reply
on December 31. 1986 and again it did not request leave
to file late. The record was closed on October 27. 1986.
FINDINGS OF FACT
East Tennessee
3. East Tennessee is a nonprofit corporation organized
in 1983 for the purpose of operating public television
facilities in East Tennessee. ETPC Exh.1 at 1. East Tennessee
is governed hby a board of trustees. ETPC Exh. 1 at
2. All of its trustees are persons living in East Tennessee.
ETPC Exh. 1 at 2. 23. One-third of East Tennessee's 15
trustees are reelected or replaced each year. ETPC Exh. 1
at 23. 24-33. East Tennessee also has a community advisory
board. Id. Currently. the trustees live in Knoxville
and the surrounding communities: they include both men
and women. persons employed at the station. and people
active in the civic affairs of the community. ETPC Exh. 1
at 23-34.
4. In 1983. East Tenneseee began operating Channel 2.
in Sneedville. Tennessee. after the state decided that it
would no longer operate noncommercial television stations.
Tr. 77: ETPC Exh. 6 at 1. Sneedville is 56 miles
northeast of Knoxville and is separated from Knoxville by
mountainous terrain: although Channel 2's transmitter is
located in Sneedville, the studios. offices, and operating
staff for Channel 2 are located in Knoxville on the
campus of the University of Tennessee. ETPC Exh. I at 1,
3. Channel 2's instructional programs receive financial
support from the state. ETPC Exh. 1.
5. East Tennessee represents that it will operate Channel
15 independently of its operation of Channel 2 but it
will operate the two stations jointly when the programming
needs of the two service areas are the same. ETPC
Exh. 1 at 2. East Tennessee will use Channel 2's existing
staff and facilities. Currently, Channel 2's signal reaches
Knoxville and its schools only where there is CATV. Tr.
35. In surrounding Knox County, however, there is no
CATV and Channel 2's signal is not received. Id. While
Channel 15's signal will overlap with the Channel 2
service area, the operation of Channel 15 will extend East
Tennessee's instructional programs to 12-15 school systems.
Initiation of service on Channel 15 will provide
Knoxville with its first city grade signal from a public
television station. Knoxville is the only major Tennessee
city currently without such service. A city grade signal
will also permit the Knoxville City schools to use television
sets in each classroom. Tr. 35. This means that they
