RECEIPT REQUESTED, to Franklin Broadcasting Co.,
237 Western Blvd., Jacksonville, NC 28540.
7. The Commission's authority to institute rule making
proceedings, showings required, cut-off procedures, and
filing requirements are contained in the attached Appendix
and are incorporated by reference herein. NOTE: A
showing of continuing interest is required by paragraph 2
RM-5438 of the Appendix before a channel will be allotted.
8. Interested parties may file comments on or before
February 19, 1987, and reply comments on or before
March 6, 1987, and are advised to read the Appendix for
the proper procedures. Additionally, a copy of such comments
should be served on the petitioners, or their counsel
or consultant, as follows:NOTICE OF PROPOSED RULE MAKING

By the Acting Chief, Policy and Rules Division:
1. The Commission has before it a petition for rule
making filed by Employee Owned Broadcasting Corp.,
("petitioner"), licensee of Station WEYQ-FM, Channel
271A at Marietta, Ohio, requesting the substitution of FM
Channel 271B1 for Channel 271A at Marietta and the
modification of its license to specify operation on the new
frequency.' In order to accomplish this substitution,
Channel 291A must be substituted for unused but applied
for Channel 272A at Ravenswood, West Virginia.' Petitioner
submitted information in support of its proposal
and expressed an intention to apply for the channel.
2. We believe the petitioner's proposal warrants consideration.
Channel 271B1 can be substituted for Channel
271A at Marietta in compliance with the Commission's
minimum distance separation requirements with a site
restriction of 18.1 kilometers (11.2 miles) southwest of the
community in order to avoid a short spacing to Station
WVAQ(FM), Channel 270B, Morgantown, West Virginia.
3. Since Marietta is located within 320 kilometers (200
miles) of the U.S.-Canadian border, the proposal requires
concurrence by the Canadian government.
4. We shall propose to modify the license of Station
WEYQ-FM to specify operation on Channel 271B1. In
accordance with our established policy we shall not accept
competing expressions of interest nor require that
the petitioner demonstrate the availability of an additional
equivalent channel pursuant to Section 1.420(g). See
Modification of FM Broadcast Licenses to Higher Class Co channel
of Adjacent Channels, 51 FR 20290, June 4, 1986.
5. In view of the fact that Marietta, Ohio, could receive
its first wide coverage FM station, the Commission proposes
to amend the FM Table of Allotments, Section
73.202(b) of the Rules, with regard to the following
